I never even read their ToS, because I assumed I was going to violate them. In terms of copyright anyway. Same with filesharing sites. Maybe I'll go read, just out of curiosity.

Re: inconsistency, it's probably just very open to individual interpretation, and maybe different employees have the job of trawling through for stuff they don't like?
